Terms of Service
این سند هنوز به فارسی در دسترس نیست؛ نسخهٔ انگلیسی نمایش داده میشود.
1. Who we are and what these Terms cover
These Terms of Service ("Terms") are a contract between Ajansify ("Ajansify", "we", "us") and you, the person or business that opens an account in or uses the Ajansify service. Our company details are on the Legal Notice (Imprint) page.
You accept these Terms when you tick the box at sign-up. If you use Ajansify for a business, you accept them on behalf of that business.
These documents form part of these Terms:
- the AI & Acceptable Use Policy;
- the Data Processing Agreement, for personal data we process on your behalf;
- for paid subscriptions, the order summary shown at checkout and the Distance Subscription Agreement.
Before you pay, we show you the Pre-Contract Information. If these documents conflict, the Data Processing Agreement prevails on personal data, and for consumers the provision more favourable to the consumer prevails.
How we process personal data is explained in the Privacy Policy and, for users in Turkey, the KVKK Privacy Notice (Turkey). These are notices, not part of the contract.
2. Definitions

3. Who can use Ajansify
You must be at least 18 years old. The Service is not directed at children. If you register for a business, you confirm that you are authorised to bind it to these Terms; "you" then means the business.
Give accurate information and keep it up to date. We may refuse a registration, for example for a disposable e-mail address, an account previously closed for a breach, or an attempt to obtain more than one free trial.
4. Your account and security
Keep your password and verification codes confidential. Each person who uses the Account needs their own login. We use security checks at sign-up and login, such as e-mail verification codes and bot protection.
You are responsible for activity in your Account unless it results from a failure of our security. If you suspect unauthorised access, tell us at [email protected] without delay.
5. Team members
The Account Owner can invite Team Members and give them roles and brand-level permissions; the number of Team Members may depend on the Plan. Each Team Member accepts these Terms when joining.
The Account Owner is responsible for what Team Members do in the Account, including the Credits they use and the content they publish, and can change or remove their access at any time.
6. The Service
Ajansify helps brand owners create social media content with artificial intelligence (AI), using AI models provided by third parties. Depending on your Plan, the Service includes:
- a brand profile built from your answers and your website's public content, and AI-assisted audience research;
- content plans, captions, images, carousels, stories and videos (including AI video, motion graphics, voice-over, AI talking-person video with lip-sync, mascots, stock footage and synthesised music);
- posters, menus (with a public QR menu page), catalogues, corporate identity items, cover images, ad copy and visuals, trends and multi-language content;
- a visual editor, a Media box and a Files area;
- publishing and performance metrics through Third-Party Services you connect, cloud storage connections and Google Business Profile reviews.
The AI generates images without text. Text and logos are added by our software and can be changed free of charge in the editor. The Service does not currently publish ads on advertising platforms; you publish ad materials yourself.
Some files, such as QR menu pages, can be opened by anyone with the public link; share such links only for content you want to be public. Features marked as beta may change or be withdrawn.
7. Free trial
New customers get a 7-day free trial. You need to add a payment card to start it. Each person and business can use the trial only once. Trial Credits expire when the trial ends.
We send you a reminder before the trial ends. If you cancel on the Subscription page before the trial ends, you pay nothing. Otherwise, the Plan you chose starts automatically when the trial ends and the first payment is taken from your card. The checkout page shows the date and amount of this first payment.
8. Subscriptions, renewal and plan changes
Plans are billed monthly or yearly. Your subscription renews automatically at the end of each Billing Period for a period of the same length until you cancel it, and renewal fees are charged to your registered card. For yearly Plans, we send a reminder before renewal.
If you are a consumer: a yearly subscription is a fixed-term contract and does not renew for another year without your approval. Before the year ends, we ask you to approve the renewal. If you do not, your subscription ends at the end of the year and you are not charged for a new year.
Upgrades take effect immediately; the amount due is shown before you confirm. Downgrades take effect at the end of the current Billing Period.
We may change the prices and contents of Plans. We tell you at least 30 days in advance by e-mail or in the Service. Changes apply from your next Billing Period, never in the middle of a paid period. If you do not accept a change, you can cancel before it takes effect.
9. Credits
AI operations use Credits. Generating, regenerating, revising and some supporting AI operations may each use Credits. Your balance and the Credit cost of operations are shown in the Service. We may change Credit costs for the future.
- Plan Credits expire at the end of each Billing Period and do not carry over.
- Trial Credits expire when the trial ends.
- Extra Credit packs are valid for the period stated on the purchase page.
- Credits from a reward programme (for example for invitations or sharing), if offered, follow that programme's rules.
Credits are not money or electronic money. They have no cash value, cannot be transferred or sold and are not refundable, without prejudice to consumers' statutory rights.
10. Payment and taxes
Payments are processed by our payment institution, İyzico. We do not store your card details; we receive only a card reference and masked card information.
The order summary shows the price, currency and Billing Period before you pay. Prices shown to consumers include VAT and other applicable taxes; for Business Customers, the order summary states whether taxes are included. Invoices are issued based on your billing profile and delivered electronically.
To verify your card, a small amount may be charged or reserved and is then refunded or released; the timing depends on your bank. If a payment fails, we let you know and may try again. While a payment is outstanding, we may restrict paid features.
11. Cancellation and refunds
You can cancel your subscription at any time on the Subscription page of your Account. Cancellation takes effect at the end of the current Billing Period, and you keep access until then.
Fees paid are not refunded. This includes partly used Billing Periods, the remaining months of a yearly Plan and unused Credits.
Statutory rights reserved: this rule does not limit consumers' rights under mandatory law, such as the right of withdrawal, the right to terminate and refund rights under consumer subscription rules. See the Cancellation, Withdrawal & Refund Policy.
12. Customer Content
You keep all rights in your Customer Content. You give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, adapt, display and transmit it only to provide the Service to you, including sending it to our AI providers and to the Third-Party Services you connect, and publishing it on your instruction. The licence ends when the content is deleted, except for copies we must keep by law.
We do not use Customer Content to train our own AI models. We use our AI providers' business services, which do not use your content to train their general models. We learn your preferences (for example from approvals and revisions) only to personalise the Service for your brand. We may create aggregated, anonymous usage statistics without Customer Content to improve the Service.
You confirm that you hold all rights and permissions needed for your Customer Content, including the consent of people whose face, voice or name appears in it, and that it complies with the law and our AI & Acceptable Use Policy.
13. AI Outputs
Ownership. As between you and us, and to the extent the law allows, Outputs belong to you, and we assign to you any rights we may have in them. Whether an Output is protected by copyright depends on each country's law; we do not guarantee that it is. Templates, blocks, illustrations, synthesised music, fonts and other elements of the Service remain ours or our licensors'; we grant you a perpetual, non-exclusive licence to use them as part of your Outputs. Stock media from Pexels or Pixabay is subject to those providers' licences.
No exclusivity. AI may produce the same or similar Outputs for other users. You have no exclusive right to a style, idea or similar result.
Review before publishing. Outputs may be inaccurate or out of date, may resemble others' works or may infringe third-party rights. Review every Output, including facts, prices, claims, names and trademarks, before you publish or use it. You are responsible for what you publish.
Labelling. You must label Outputs where you publish them as the law requires. In particular:
- Under Article 50(4) of the EU Artificial Intelligence Act, image, audio or video content that resembles real persons, objects, places or events and would falsely appear authentic (a "deepfake") must be clearly disclosed as AI-generated or manipulated.
- Under Turkey's Regulation on Commercial Advertising and Unfair Commercial Practices, as amended with effect from 1 August 2026: an AI character indistinguishable from a real person must be disclosed in ads; ads must not show an AI copy of a real person using or recommending a product; consumer reviews whose purchase has not been verified must not be used in ads; and influencer posts must carry a "Reklam" (Advertisement) or "Tanıtım" (Promotion) label.
We may add machine-readable markers (such as metadata or watermarks) to Outputs to show they were generated with AI. Do not remove, alter or hide them. They do not replace the labelling you must add.
14. Ajansify signature
Depending on your Plan and settings, we may add the signature "Created by @ajansify" (in Turkish, "@ajansify ile hazırlandı") to captions published through the Service, and some visuals may carry "Created by Ajansify". We never add a signature to ads. Whether you can turn it off depends on your Plan and settings.
15. Third-Party Services
You can connect Third-Party Services such as publishing tools (for example Metricool, Buffer, Postiz, Zernio, Upload-Post, bundle.social and Publer), cloud storage (Google Drive, Dropbox, OneDrive, Box) and Google Business Profile. By connecting them, you accept their terms and authorise us to access them within the permissions you grant.
- Publishing. We send your content to the tool you choose, which publishes it to your social accounts. Publishing may fail, be delayed or be changed by the tool or the social network, so check that your posts went live. Metrics are shown as the tool provides them.
- Cloud storage. We read only the files you select and save to your cloud only when you press the save button, into a folder named "Ajansify". We never delete files in your cloud. You can disconnect at any time in Settings → Cloud storage or in your provider account.
- Google reviews. We read reviewer names and review texts so you can turn reviews into posts. You must use them lawfully, including under advertising rules and Google's terms.
We do not control Third-Party Services and are not responsible for their availability, changes to their features, prices or policies, or their decisions about your accounts. If a Third-Party Service stops working with Ajansify, we may remove the related feature.
16. Acceptable use
Use the Service in line with the law and our AI & Acceptable Use Policy, which forms part of these Terms. Anyone can report illegal content via our Report Content & Points of Contact page.
17. Data protection
We process your personal data as described in the Privacy Policy and, for users in Turkey, the KVKK Privacy Notice (Turkey).
For personal data in Customer Content (for example people in your photos, your Google reviewers or your own customers), you are the data controller and we are your processor. Our Data Processing Agreement applies to this processing and forms part of these Terms; our providers are listed on the Service Providers & Sub-processors page. You need a lawful basis for this data and must inform the people concerned and, where required, obtain their consent. Do not upload special categories of personal data (such as health data) unless the law allows it.
We send service messages (such as invoices, security alerts and trial reminders) without separate consent. Campaign messages are sent only with your consent under the Marketing Communications Consent, which you can withdraw with the unsubscribe link in each message or by writing to [email protected].
18. Confidential information
Each party keeps confidential the non-public information it receives from the other in connection with the Service and uses it only to perform these Terms. This does not apply to information that is public through no fault of the recipient, that it already lawfully knew, or that it must disclose by law or by order of an authority.
19. Our intellectual property
The Service, including its software, design, templates, blocks, illustrations and the Ajansify name and logo, belongs to us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use it during your subscription. You may not copy, sell or reverse-engineer the Service, except as mandatory law allows. We may use any feedback you send us freely.
20. Availability and changes to the Service
We take reasonable care to keep the Service available and secure, but we do not guarantee that it will be uninterrupted or error-free. Maintenance, high demand or outages at our providers may cause interruptions or waiting times. We try to announce planned maintenance in advance.
We may change, improve or remove features, AI models and providers for valid reasons, such as security, legal requirements, technical developments or changes at our providers. Such changes cost you nothing extra, and we tell you about material changes in advance.
If you are a consumer: if a change negatively affects your access to or use of the Service in more than a minor way, you can end the contract free of charge within 30 days of our notice or of the change, whichever is later. We then refund any prepaid fee for the period after termination. Business Customers can cancel if a change significantly reduces the core features of their Plan.
21. Suspension and termination
We may restrict content or features, suspend your Account or terminate these Terms if:
- you seriously or repeatedly breach these Terms or the AI & Acceptable Use Policy;
- a payment remains outstanding;
- it is necessary to prevent fraud, trial abuse or a security risk; or
- a court, an authority or the law requires it.
Where reasonable, we warn you first and give you a chance to fix the problem. In urgent cases, such as clearly illegal content, security threats or legal orders, we may act immediately.
When we restrict content or your Account, we send you a statement of reasons: what we did, the facts, the contractual or legal ground, and how to appeal. You can appeal by replying to the notice or writing to [email protected]; a person reviews every appeal.
If we terminate because of your breach, fees paid are not refunded, without prejudice to consumers' statutory rights. If we discontinue the Service or end your subscription for other reasons, we give at least 30 days' notice and refund prepaid fees for the unused period.
You can end your subscription as described in section 11. To close your Account, write to [email protected].
22. Data export and deletion
While your Account is open, you can download your files and Outputs or save them to your connected cloud storage. You can also ask [email protected] for a copy of your data in a common, machine-readable format: account details, brand profile, uploaded files, Outputs (texts, images, videos, PDFs) and content plans. This excludes our software, templates and other Service elements, and our internal security and system records. Exporting your data or switching to another provider is free of charge.
If your subscription ends but your Account stays open, we keep your data and you can ask for a copy at any time.
Export what you want to keep before closing your Account. After closure, you have 30 days to request your data. We then delete your Customer Content; backup copies are deleted within 90 days at the latest. Data we must keep by law (such as invoices) is kept for the legally required period. Business Customers' rights under the EU Data Act are not affected.
23. Warranties
We provide the Service with reasonable care and skill. Beyond that, and to the extent the law allows, we provide it "as is" and "as available", and we do not warrant particular results (such as reach, engagement or sales) or that Outputs will be accurate, unique or free from third-party rights.
If you are a consumer: your statutory rights for defective services and for the conformity of digital services are not affected.
24. Limitation of liability
Nothing in these Terms limits liability for intent or gross negligence, for death or personal injury, or any liability that cannot be limited by law.
For Business Customers, to the extent the law allows:
- we are not liable for indirect or consequential loss, lost profits, revenue, opportunities or reputation, or for data loss you could have prevented by keeping your own copies;
- we are not liable for loss caused by Third-Party Services or by Outputs you published without reviewing them;
- our total liability under these Terms is limited to the fees you paid us in the 12 months before the event giving rise to the claim.
If you are a consumer, our liability is governed by applicable mandatory consumer law, and the limitations above apply only as far as that law allows.
25. Indemnity (Business Customers)
If you are a Business Customer, you will compensate us for losses and reasonable costs (including legal fees) arising from third-party claims that result from your Customer Content, the Outputs you publish or use, your use of Third-Party Services, or your breach of these Terms or the law. We will tell you about such a claim promptly and cooperate reasonably.
26. Force majeure
Neither party is responsible for delays or failures caused by events beyond its reasonable control, such as natural disasters, war, terrorism, epidemics, strikes, cyberattacks, widespread internet or power outages, outages at key providers or acts of authorities.
27. Changes to these Terms
We may update these Terms, for example when the law, the Service or our providers change. We tell you about material changes at least 30 days before they take effect, by e-mail or in the Service, and ask you to accept them again. Changes required by law or for security may take effect sooner.
If you do not accept a material change, the previous Terms apply until the end of your current paid Billing Period, and your subscription then ends without renewal. You can also cancel earlier.
28. Notices
We send notices to your Account e-mail address or show them in the Service; keep your e-mail address up to date. You can reach us at [email protected]. Formal legal notices can also be sent to our registered electronic mail (KEP) address ajans,[email protected] or by post to Adres Adres Adres Adres Adres Adres.
29. Governing law and disputes
These Terms are governed by the laws of the Republic of Turkey. For Business Customers, the courts and enforcement offices of Ankara Merkez have jurisdiction.
If you are a consumer in Turkey: you can apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) within the monetary limits set each year by the Ministry of Trade, and to the Consumer Court (Tüketici Mahkemesi) for disputes above these limits, at your place of residence or where the transaction took place. Before filing a case at the Consumer Court, you must apply to a mediator where the law requires it.
If you are a consumer outside Turkey: the choice of Turkish law does not deprive you of the protection of the mandatory laws of your country of residence, and you can bring claims before the courts or consumer bodies of your country where the law allows.
Before starting proceedings, please contact [email protected] so that we can try to solve the problem together.
30. General provisions
- These Terms and the documents listed in section 1 are the entire agreement between you and us about the Service.
- If a provision is invalid, the rest remain in force. Not enforcing a right immediately does not waive it.
- You may not transfer your rights under these Terms without our consent. We may transfer the contract to a successor or group company if your rights are not reduced, and we will inform you.
- Our business books and electronic records may be used as evidence; you may always present evidence to the contrary.
- These Terms are published in several languages with the same content. If versions conflict, the Turkish version prevails; for consumers, any ambiguity is interpreted in the consumer's favour.
