KVKK Explicit Consent Form (Turkey)

This form is issued by the data controller Ajansify ("Ajansify") under article 5(1) of the Turkish Personal Data Protection Law No. 6698 (KVKK), only for two optional purposes that rely on explicit consent. Full information about how we process your personal data is in the KVKK Privacy Notice.

1. What you should know about your consent

• Giving consent is optional and is not a condition of the service. You can keep using Ajansify without it.
• You give consent separately for each purpose. You can choose one, both or neither.
• We do not ask for consent for processing that relies on another legal ground. This form covers only the two purposes below.
• You can withdraw your consent at any time, free of charge, by writing to [email protected]. You can also give and withdraw your face and voice consent (Purpose 2) in the app under Settings → Privacy. Withdrawal does not affect the lawfulness of processing carried out before it.
• Approval for campaign messages (commercial electronic messages) is separate from this form: see Marketing Communications Consent.

2. Purposes

Purpose 1 – Marketing and personalisation (marketing_personalization)

• Which data: identity (name, surname), contact (e-mail, phone), usage data (features you use, plan and credit movements) and preference data (language, country, sector, communication preferences).
• What for: preparing campaigns, announcements and personalised offers that suit you, and for this purpose analysing your data and grouping you by interest (profiling).
• Who receives it: our hosting and storage provider Contabo GmbH (Germany) and our e-mail, SMS and push notification providers (Netgsm and İleti Merkezi in Türkiye; Twilio, OneSignal and our e-mail delivery provider abroad). The current list is on Service Providers & Sub-processors.
• How long: until you withdraw consent or close your account. The analysis results created for this purpose are then deleted or anonymised.
• If you do not consent: you use the service in the same way, but we do not prepare personalised offers for you. If you approved campaign messages, you may still receive general campaign messages.

Purpose 2 – Face and voice data (face_voice)

• Which data: the images of your own face (photo or video) and your voice recordings that you upload, and the talking videos, avatars/mascots and voice-overs created from them.
• What for: creating AI talking videos (lip sync), avatars or mascots and voice-overs in your own voice. This data is not used to identify you or verify your identity.
• Who receives it: the AI providers abroad that perform the job (for example fal.ai, ElevenLabs, Google; United States) and our hosting and storage provider Contabo GmbH (Germany). The transfer abroad itself does not rely on consent but on standard contracts signed under article 9 KVKK; the consent you give here concerns processing the data for this purpose.
• How long: until you delete the files, withdraw consent or close your account. When you withdraw consent, we stop using this data in new content and delete the face and voice files you uploaded within 30 days at the latest. When an account is closed, the data is deleted within 30 days, and from backups within 90 days at the latest.
• If you do not consent: you can keep using the service; you only cannot use your own face or voice in the talking-video and voice-over features. You can continue with ready-made voices and AI-generated characters.

This consent covers only your own face and voice. To use another person's face or voice, you must obtain that person's permission (AI & Acceptable Use Policy).

3. Consent statements

You give the statements below separately for each purpose, by your own choice:

• For Purpose 1: I have read the KVKK Privacy Notice. I give explicit consent to the processing and analysis (profiling) of my identity, contact, usage and preference data for campaigns, announcements and personalised offers.
• For Purpose 2: I have read the KVKK Privacy Notice. I give explicit consent to the processing of my own face images and voice recordings to create talking videos, avatars/mascots and voice-overs, and to their transmission for this purpose to AI providers abroad.

When you give or withdraw consent, and which version of this form you saw, is recorded as proof and kept for the term of the contract and 10 years after it.
